How do you obtain a criminal record extract online in Algeria?

On 15 February 2021 the Ministry of Justice launched a service for requesting and collecting remotely the electronic version of bulletin no. 3. Initial registration is done on the e-casier portal, with civil-status details and a mobile number. A secret code is sent by message to confirm registration, then the PDF document is issued.

How long does it take to receive the document?

The ministry states that the citizen receives the electronic document in PDF format instantly once the request is validated, and can save and print it. Subsequent retrievals are made from the ministry's services portal, without repeating the initial registration.

What information is needed to complete the form?

Surname and given name in Arabic and Latin characters, sex, date and place of birth, birth certificate number, father's name, mother's surname and given name, nationality, marital status, occupation, address and a reachable mobile number. The portal form is served in Arabic.

Does the online service work if you have convictions?

Yes. The official Ministry of Justice announcement expressly states that the service covers the issuance of the criminal record, bulletin no. 3, without or with convictions. It is therefore not a service restricted to clean records.

Is a criminal record extract required to start a business?

The list of documents for registering an individual trader in the commercial register, published by the Ministry of Trade, mentions "un extrait du casier judiciaire (N° 3)", alongside the birth certificate extract, the title to the premises, the 4,000 DA stamp duty receipt and the registration fee receipt. Check the list in force with the CNRC before travelling.

Can a criminal record be requested in a company's name?

No. The criminal record concerns an individual. In a company file, it is the manager's or director's bulletin that is required, each person concerned making their own request with their own civil-status data.

What is bulletin no. 3 of the criminal record?

The criminal record lists the criminal convictions handed down against a person. It comes in several bulletins that differ in content and in who may receive them. Bulletin no. 3 is the one the person concerned can request and obtain for themselves, and it is therefore the only one that circulates in an ordinary administrative file.

It is this bulletin that administrations, employers and counters mean when they ask for "a criminal record extract". The official list of commercial register documents published by the Ministry of Trade names it explicitly, referring to "un extrait du casier judiciaire (N° 3)".

The document is issued by the services of the Ministry of Justice. It exists as a paper version collected from the competent court, and since February 2021 as an electronic version requested and collected entirely online.

From Monday 15 February 2021, the Ministry of Justice launched the service for requesting and collecting remotely the electronic version of the criminal record, bulletin no. 3. An important point for entrepreneurs: the e-casier form is served in Arabic. Prepare the exact civil-status details, in particular the birth certificate number and the spelling of the parents' names, before starting to type.

The information the form requires

The online form asks for no attachments, but it demands exact civil-status data. Prepare:

Surname and given name, entered in both Arabic and Latin characters.
Sex and date of birth.
Place of birth, as it appears on the civil-status record.
The birth certificate number, which is the field most often copied incorrectly.
The father's name, and the mother's surname and given name.
Nationality and marital status.
Occupation, address and a reachable mobile number, used to receive the confirmation code by message.
Completion of the anti-robot check, then the declaration that all data entered on the form is personal and accurate.

Requesting bulletin no. 3 step by step

Gather the civil-status data. Keep a recent birth certificate in front of you: the certificate number and the official spelling of the names determine whether the request succeeds.
Open the e-casier portal and complete the registration form with the identity details and the mobile number.
Confirm the registration. The ministry states that the applicant receives a secret code by message, used to confirm registration.
Validate the request after re-reading every field, then accept the declaration of accuracy.
Collect the document. The official announcement states that the citizen receives the electronic document in PDF format instantly, and can save and print it.
Keep your credentials. Subsequent retrievals are made from the ministry's services portal, without repeating the initial registration.
Check that the printout is legible before attaching the document to a file, especially where the counter asks for a paper copy.

Cost and turnaround

The electronic version is the fastest and cheapest route. The Ministry of Justice announcement states that the criminal record issued electronically is exempt from the judicial tax, in accordance with the provisions of the 2020 finance act, and that the PDF file is delivered instantly.

The traditional route remains open: the request is filed with the competent court and the document collected at the counter, under the rules and duties applicable to that route. It retains its usefulness where the applicant has no digital access, or where a civil-status particularity blocks the online entry.

No general validity period is attached to the bulletin by the service itself. It is the requesting bodies that ask for a recent document, which in practice means requesting a fresh bulletin for each file rather than reusing an old copy.

The criminal record in a company formation file

The list of documents for registering an individual trader in the commercial register, published by the Ministry of Trade, comprises an application on the forms supplied by the National Commercial Register Centre, a title deed for the commercial premises or a notarised lease, a birth certificate extract, a criminal record extract no. 3, a receipt evidencing payment of stamp duty set at 4,000 DA, a receipt for the registration fees, and the approval or authorisation issued by the competent authorities where the activity is regulated. Beyond registration itself, bulletin no. 3 is requested whenever an authority must check a person's standing: processing an approval for a regulated activity, a job application file, opening certain accounts or banking relationships, or files submitted to foreign authorities.

A practical tip: request the bulletin when you assemble the file, and request it for each person concerned. In a company, it is the manager's or director's civil status that is examined, not the company's.

The mistakes that cause a request to fail

Entering the wrong birth certificate number. It is the leading cause of rejection, because the service cross-checks the request against the civil-status registers.
Transcribing names differently from the birth certificate. The entry must reproduce the official spelling, in Arabic as well as in Latin characters.
Entering an unreachable mobile number. The confirmation code arrives by message: without access to the handset, registration cannot be completed.
Assuming the service is limited to clean records. The ministry expressly states that the service covers records with or without convictions.
Reusing an old copy. Counters ask for a recent document, and the electronic version is free: there is no reason to recycle an old bulletin.
Requesting a bulletin in the company's name. The criminal record concerns an individual. In a company file, it is the director who is targeted.
