Hiring a foreign employee in Algeria: the 10 questions employers ask

To hire a foreign employee in Algeria, the employer first obtains the APT, which opens the work visa, then the work permit at the wilaya employment directorate, then the resident card.

This route comes from law 81-10 of 11 July 1981 on the employment of foreign workers (JO 1981 no. 28). The entry and stay of the foreigner fall under law 08-11 of 25 June 2008 (JO 2008 no. 36).

No: a non-resident stays for up to 90 days with no professional activity and no salaried work, so no salaried work is allowed on a business visa.

This is article 10 of law 08-11. The consular visa is valid for 2 years at most and 90 days per entry (article 8). The employee therefore works on the work visa, which the employer's APT opens.

A foreign employee's resident card is issued for 2 years at most and never exceeds their work authorisation.

This is article 16 of law 08-11. The card is issued by the wilaya of residence, after the work permit. No card is required before the age of 18.

The spouse and children obtain their visas after the employee's resident card, never right after the work visa.

Article 19 of law 08-11 opens family reunification to the resident foreigner. Children under 18 do not need a resident card, only their entry visas. An adult spouse applies for their own card (article 16), 15 days before the end of their visa (article 18).
