What the text says

The order sets the terms and conditions for the final regularisation of vehicles brought in from European countries, imported by foreign nationals, in an exceptional framework and for humanitarian reasons, with a provisional customs pass, registered and sold without completing the procedures in force.

It is issued under article 167 of law n° 21-16 of 25 Joumada El Oula 1443 corresponding to 30 December 2021.

Vehicles covered and exclusions

The vehicles are determined according to the list drawn up by the competent services.

  • Vehicles seized by the competent services, whose owners already benefited from provisional regularisation.
  • Vehicles brought into the national territory before 3 June 2021 and not seized.
  • Owners of vehicles subject to a final confiscation judgment or a final settlement are excluded.

Procedures and amounts

For a seized vehicle, the owner files the original provisional circulation title with the customs receiver, with the receipt for the deposit estimated at 5% of the value of the seized vehicle. The receiver then issues the final circulation title.

For a vehicle brought in before 3 June 2021 and not seized, the owner files a request with the registration card and pays 5% of the vehicle's value, set by the customs services. This flat-rate revenue covers all import duties and taxes and the financial charges of the regularisation.

In both cases, the vehicle then goes through a conformity check with the mines services, and the registration file is filed with the services in charge of vehicle registration.

Vehicles sold at public auction

Owners of vehicles seized and sold at public auction before a final judgment receive back the sale proceeds held with the customs receiver, after deduction of the flat amount of 5% of the vehicle's value.

The refund follows a request to the competent customs receiver, with a copy of the final judgment.

For foreign investors

The text covers vehicles imported by foreign nationals. For registration, it requires a copy of a valid passport for foreigners.
